It is the same principle of how an estate agent knows the value of your home. If a similar house in your street has recently sold for x, then if your house is in better condition, it follows that it should sell for more. So, it the court has awarded y for a particular injury and your personal injury is worse, then it follows that you should receive more that the value of y. Similarly, if your injury is not as severe, then it again follows that you should receive less than y in proportion to the injury.
