The operators of all supermarkets owe a duty of care to their customers at all times, this does not mean just in the store itself, but also in the foyer, the toilets, the car park and petrol station. Every year we investigate many slipping and tripping accidents that happen in supermarkets and shops. By far the most common is slipping on something that has been spilled on the floor. It is not a matter of the store saying you should have looked where you were going. The store should ensure that their cleaning and housekeeping regime should be so good as to prevent these types of accident. You may have noticed that in the flower and fruit and veg section in supermarkets, the stores now place mats on the floor to prevent customers slipping and falling on the terazzo floor.
It is for the stote to demonstrate that they have in place a systematic cleaning programme. This is often not the case.
