It is expected that all drivers should exercise the same standard of care. This means learner drivers as well as experienced drivers, should demonstrate the same duty of care. In Nettleship v Weston [1971] 2 QB 691, a learner driver crashed the car she was driving and injured her instructor. The case before the courts was……should she exercise the same standard of care as an experienced driver? The Court of Appeal held that even though she was a learner driver, she should have exercised the same level of care as a reasonably compemetent experienced driver. Despite this, Lord Denning told her that she should not consider herself morally blameworthy.
