Assault in nightclub/bar/pub

If you have been assaulted by door staff at a night club/pub/bar, then you have the option of suing the person who assaulted you, the employer of the door staff, in vicarious liability (this might be a separate company to the owner of the club) or make a criminal injury compensation claim to the CICA.

Provided you have notified the police in a timely manner and assisted them with their enquiries, then you may well be eligible for a criminal injury compensation claim. All door staff have to be registered by the SIA and should wear a photo ID badge. The Security Licencing Authority  are chrged with policing the security industry. Their website is www.the-sia.org.uk. The SIA invite individuals to report illegal activity.

Penalities for offences under the Private Security Industry Act 2001 are severe:

Persons caught working as security staff (a licensable role) without a SIA licence can face a maximum penalty of six months imprisonment and or a fine of up to £5,000.oo. Those persons who supply unlicensed staff face a similar sentence and fine. If the matter progresses to the Crown Court on indictment, then the sentence can be an unlimited fine and up to five years imprisonment.
