The Consumer Protection Act 1987 governs the safeguard of consumers from products that do not reach a reasonable level of safety. This Act allows individuals to sue producers, importers and own-branders for death, personal injury or losses on private property valued at more the £275.00. The burden of proof is on the balance of probabilities. A product will not be regarded as defective simply because it is pof poor quality or perhaps because there is a safer version now on the market.
The Consumer Protection Act is also now bolstered by the General Product Safety Regulation 2005. These Regulations came into force on 1st October 2005 and replaced the Genral Product Safety Regulations 1994. Producers, suppliers and distributors are liable if a product causes injury. The penalties for serious breaches of safety notices are a maximum fine of £20,000.00 and or a 12 months prison sentence, with lesser breaches being dealt with by way of a maximum fine of £5,000.00 and or three months imprisonment.
