Road Traffic Accidents/ whiplash/ neck injury

Car AccidentThere are many different types of road traffic accidents.  Driver, passenger, pedestrian, motor cycle, bus, bicycle etc.  If you have been injured due to the negligence of the driver (or rider) of a motor vehicle. Then you can, in normal circumstances, claim personal injury compensation.

Common injuries are whiplash to the neck, back injury and shoulder damage.  Of course, if you are knocked off a motor bike or bicycle, then your injury could be far worse.  Whatever your injury, we can help you gain compensation.  Similarly, if you are a pedestrian injured by a motor vehicle, we can assist.

We have panel solicitors who specialise in representing road traffic accident victims.  Whether you have suffered a whiplashing injury or something more serious, we have a solicitor who can get your claim underway instantly.

You will need to provide us with the registration number of the defendant’s vehicle and their contact details.  If you have their insurance details, then that is very helpful.  Also, witnesses to any type of accident are always helpful, so if anyone saw the accident, you should let us have their details as well.

If your vehicle was damaged, then provided the defendant was insured, then we can arrange to repair your vehicle and loan you a similar vehicle – click to our Credit Repair and Credit Hire page.

If you are the passenger in a vehicle and the driver is the negligent party, for example, the diver loses control of the vehicle and it strikes a tree, or crashes into the back of another vehicle, then if you are injured because of this, you can make a personal injury compensation claim.

So, a wife can proceed against a husband, or a child against a parent.  We deal with these types of cases all the time, so do not be concerned about making contact with us just because the negligent person is a family member.  The same rules apply if a work colleague is the cause of a motor injury.

If you are a driver and another vehicle runs into the back of you, then the fault lies with the other driver.  If a vehicle pulls out in front of you and you run into it, then it is the other driver’s fault.

We are all obliged by law to have in place, motor insurance if we own a motor vehicle, care, motorbike, scooter, van, lorry etc.  When an accident occurs, the insurers of the defendant have to pay the cost of repair, any personal injury compensation and the accident solicitor’s costs.

If another driver crashes into you, obtain the following:

1)  Their name, address and telephone number.

2)  Their insurance details.

3)  The names of any witnesses.

4)  The make, model and registration number of their vehicle.

5)  The details of any police officers who attend.

If the other driver smells of alcohol, telephone the police immediately.  A good tip is to take some photographs of the accident scene using your mobile telephone.  If anyone is seriously injured, ring for an ambulance as well as the police.

The other driver my say, “I’m sure we can sort this out between us”, “I’ve got a mate who owns a garage…”, “There’s no need to involve your insurers”, etc.  Trust me. You will not be able to sort it out, his mate is not his mate and he is not an approved motor repairer, he is a bricklayer (probable called Kevin) and there is every need to engage a professional to sort the whole matter out.

Ring one of our personal injury lawyers immediately for clear sound advice.  Do not listen to advice from your family, friends (unless they are solicitors of course) or blokes down the pub.  Especially, do not take advice from Kevin – remember he is a bricklayer not a personal injury accident solicitor.  Would you ask a solicitor to build a garden wall?  No, exactly.

Whiplash injuries are very painful indeed.  Seek medical advice as soon as possible.  Attend your local hospital or General Practitioner and make sure you tell the doctor you have been involved in a motor accident.  They sometimes forget to include this in your medical notes.

We can give you immediate advice on free phone 0800 169 3683.  If you are using a mobile, ask us to ring you back.
